Complaint filed: Berger, Moore conspired to ‘intimidate, interfere’ with judges

A Raleigh resident and political activist filed a formal complaint Friday accusing GOP legislative leaders of conspiring to intimidate and interfere with judges considering constitutional challenges to their enacted laws.

Greg Flynn is asking the State Board of Elections and Ethics Enforcement to investigate Senate President Pro Tem Phil Berger and House Speaker Tim Moore and to take “whatever remedial or corrective action allowed by law.”

The evidence he cites includes lawmakers’ changes to the judiciary, their consideration of judicial redistricting maps and a joint statement from Berger and Moore promising a three-judge panel “profound consequences” if they continued to “legislate from the bench.”

“This sworn complaint further alleges that Respondents Berger and Moore stand to directly benefit from their intimidation and interference tactics by continuing and perpetuating their ability to hold leadership positions, which entitle them to higher compensation and political contributions than would exist if they did not hold such leadership positions,” the document states.

On his website, Flynn wrote that “House and Senate leadership have left no stone unturned to find ways build, consolidate and retain political power.”

“Even as judges over-turn many such stones as unconstitutional Berger and Moore yet stoop to stone the judiciary,” he added.

Flynn previously filed a complaint against Sen. Ralph Hise (R-Mitchell) with the State Board of Elections, pointing out a series of problems with the legislator’s campaign disclosures. That investigation is ongoing.
